Participant Waiver, Release of Liability & Assumption of Risk

I understand that participation in dance classes, workshops, rehearsals, performances, fitness activities, and any related programs or events offered by Cloud Dance Collective LLC ("Activities") involves inherent risks, including but not limited to physical injury, psychological injury, illness, communicable or infectious disease, disability, death, and property damage.

These risks include, but are not limited to, slips, trips, falls, collisions with other participants, overexertion, strenuous movement, use of dance floors or equipment, conditions of the facilities where Activities occur, and the acts or omissions of other participants.

I voluntarily choose to participate in these Activities and knowingly and freely assume all risks associated with participation, whether known or unknown, foreseeable or unforeseeable, including risks arising from the condition of the premises, the actions or omissions of others, and, to the fullest extent permitted by Arizona law, the ordinary negligence of the released parties.

I represent that I am physically capable of safely participating in the Activities and have no medical condition that would make participation unsafe. I understand that it is my responsibility to consult a physician if I have any concerns regarding my physical condition. I agree to monitor my own physical condition throughout the Activities and to immediately discontinue participation if I experience pain, illness, injury, dizziness, or otherwise believe participation has become unsafe.

To the fullest extent permitted by Arizona law, I hereby waive, release, discharge, and covenant not to sue Cloud Dance Collective LLC, its owners, officers, employees, instructors, independent contractors, agents, representatives, affiliates, volunteers, the owners and operators of any facility or venue used for the Activities (including Studio Z Performing Arts Center, Pinnacle Dance North, Dance Barn, or any future venue where Activities are conducted), and their respective employees and agents (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or relating to my participation in the Activities, including claims arising from the ordinary negligence of any Released Party.

I further agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from my own actions or omissions while participating in the Activities, to the fullest extent permitted by law.

I understand that participation is voluntary and that I am solely responsible for any medical expenses incurred as a result of injury or illness occurring before, during, or after participation in the Activities.

In the event of an emergency, I authorize Cloud Dance Collective LLC and its instructors, employees, agents, or representatives to obtain emergency medical treatment for me if they reasonably believe such treatment is necessary. I understand that Cloud Dance Collective LLC assumes no responsibility for providing medical care and that I remain solely responsible for all medical expenses incurred.

I understand that I am responsible for my own personal belongings. Cloud Dance Collective LLC, its instructors, employees, contractors, volunteers, and the owners or operators of any venue are not responsible for the loss, theft, or damage of personal property brought to or left at any class, workshop, rehearsal, performance, or event.

I understand that Cloud Dance Collective LLC and/or the facilities where Activities are held may photograph or record classes, workshops, rehearsals, performances, or events. I grant permission for my image, likeness, voice, and appearance to be used in photographs, video recordings, or other media for promotional, educational, advertising, and marketing purposes without compensation unless Cloud Dance Collective LLC has agreed in writing prior to my participation to exclude me from promotional media.

This Waiver shall be governed by the laws of the State of Arizona. Any dispute arising out of or relating to this Waiver or my participation in the Activities shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.

If any provision of this Waiver is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

I agree that my electronic acceptance of this Waiver constitutes my legally binding signature and has the same force and effect as a handwritten signature.

I acknowledge that I have carefully read this Waiver in its entirety, fully understand its contents, understand that I am giving up substantial legal rights, including the right to sue, and voluntarily agree to its terms.
