Participant Waiver, Release of Liability, and Assumption of Risk

1. I understand that participation in dance classes, fitness sessions, rehearsals, performances, and related activities at Cloud Dance Collective (“Activities”) involves inherent risks, including but not limited to the risk of serious personal injury, psychological injury, illness, disability, death, and property damage. I acknowledge that these risks may arise from my own actions or inactions, the actions or inactions of others, or the negligence of Cloud Dance Collective, its owners, instructors, staff, volunteers, or agents (“Cloud”). I understand that although Cloud takes precautions to reduce risks, it cannot guarantee my safety. NOTWITHSTANDING THESE RISKS, I VOLUNTARILY CHOOSE TO PARTICIPATE IN ACTIVITIES AND ASSUME ALL RISKS OF INJURY, ILLNESS, DISABILITY, DEATH, PROPERTY DAMAGE, OR LOSS, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF CLOUD OR OTHERWISE.

2. I waive and release all claims, now known or hereafter known, against Cloud arising out of or related to my participation in Activities, including claims based on negligence, personal injury, psychological injury, illness, disability, death, property damage, or financial loss. I agree not to bring any such claim against Cloud and forever discharge and release Cloud from liability for such claims.

3. I confirm that I am in good health, physically able to participate safely in Activities, and have no medical condition that would make participation unsafe. I agree to follow all instructions, guidelines, and cautions of Cloud at all times. If at any time I believe conditions are unsafe or that I am no longer capable of participating safely, I will immediately stop participating.

4. I hereby consent to receive emergency medical treatment as deemed necessary by Cloud if I am injured or require medical care during Activities. I agree that I am solely responsible for all costs associated with such treatment and related medical transportation. I release and hold harmless Cloud from any liability arising from such medical care.

5. This Waiver constitutes the entire agreement between Cloud and me regarding the subject matter contained herein and supersedes all prior written or oral agreements. If any part of this Waiver is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

6. I ACKNOWLEDGE THAT I HAVE READ THIS WAIVER CAREFULLY, UNDERSTAND ITS TERMS, AND AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE CLOUD DANCE COLLECTIVE.
